Listing Content Licence

“Listing content” means everything you submit when you create or edit a listing: photographs, floor plans and other images, the title and description, and the figures you enter such as price, cap rate and occupancy. This licence is part of the Terms of Service and applies whenever you publish a listing on 1031 MLS.

You own your listing content. This licence does not transfer any ownership to us — it only gives us permission to use your content in the ways described below so we can run the marketplace. If you did not create a photograph yourself, you are confirming you have the right to grant this licence over it.

By publishing listing content, you grant the operator of 1031 MLS a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, reformat, resize, adapt for display, and publicly display and distribute that content, for the following purposes only:

• showing your listing on the marketplace, in search results and on maps;
• generating derivative versions needed to display it well — thumbnails, resized images, and the social-card image composited from your hero photo, price and cap rate;
• including your listing in emails, alerts and digests to members who asked to be notified about matching property; and
• promoting the marketplace and your listing in a way that is plainly attributable to your listing.

What we do not do with it

We do not sell your photographs, and we do not license them to third parties for their own products. The licence is limited to operating and promoting the marketplace on which your listing appears.

When you publish listing content, you represent that:

• you own it or have the rights and permissions needed to grant this licence;
• it does not infringe anyone else’s copyright, trademark, privacy or other rights;
• any person recognisable in a photograph has consented to its use where consent is required; and
• it is accurate and not misleading about the property.

If someone tells us your listing content infringes their copyright, we handle it under our DMCA policy.

The licence lasts while your listing is live and for a reasonable period afterwards to allow for backups, caches and search indexes to clear. When you remove a listing or close your account, we stop displaying its content on the marketplace.

Two things survive removal, for a limited and specific reason: copies retained in routine backups until they age out, and any content we are required to keep to comply with the law or to resolve a dispute about a transaction. We do not keep displaying removed content, and we do not use it for any new purpose after removal.
